Terms and Conditions
These Terms and Conditions apply to all commissioned artwork services provided by Megan Duhamel, trading as amegstudio.
By accepting a quote and paying the required deposit, you agree to these Terms and Conditions.
Joining the Collectors List 2027 does not create an obligation to purchase and does not secure a commission place. Your place is only secured once a booking has been offered and the deposit has been paid.
Your Commission
Each commission is a one-off original artwork. The agreed artwork style, size, subjects, colours, elements, price and estimated timeframe will be confirmed in your individual quote.
The commission price includes the agreed artwork process, framing and included revisions. Shipping is charged separately unless stated otherwise in your quote.
All prices are in Australian dollars and include GST.
Booking and Payment
A 50% deposit is required when a commission booking is offered.
Your place in Meg’s schedule is secured once the deposit has been received.
The remaining balance is payable upon receipt of the final invoice and must be paid before the artwork is delivered.
Payment plans may be offered by Meg on a case-by-case basis and must be agreed in writing. If an agreed payment or required information is not received by the requested deadline, the commission may be delayed or cancelled.
Client Cancellation
You may request to cancel your commission by contacting Megan in writing.
Because commission places, time and materials are reserved specifically for each client, refunds are assessed case by case rather than being automatically available.
When considering a refund, Meg will take into account:

Whether the Photoshop visualisation or painting process has begun

The amount of work already completed

Materials already purchased

Any other reasonable, non-recoverable costs
If the artwork process has not yet commenced, some or all of the deposit may be refunded. If the Photoshop visualisation, painting or material purchases have commenced, the refund may be reduced or unavailable.
If Meg needs to cancel a commission and cannot complete the agreed artwork, all amounts paid for the uncompleted commission will be refunded.
These terms do not limit any rights you may have under the Australian Consumer Law.
Artwork Process and Revisions
Before painting begins, Meg will provide a Photoshop visualisation for your approval.
The following visualisation revisions are included:

Keepsake: one revision round

Legacy: two revision rounds

Heirloom: Up to five revision rounds
A revision round means one consolidated list of reasonable changes. Additional revisions or major changes may be charged at the hourly rate stated in your quote. Meg will advise you of any additional cost before completing the work.
Once the painting is complete, Meg will send you an image for confirmation. One round of minor adjustments is included at this stage. Further adjustments or substantial changes may incur an hourly fee.
Client Information and Approvals
You agree to provide clear reference photographs, accurate information and the required artwork details.
You confirm that you have permission to provide any reference photographs used for your commission.
You may update your photographs, chosen elements and artwork details before the painting process begins. Changes requested after approval may be treated as additional revisions and may incur an extra fee.
If required information, payment or approval is not provided by the requested deadline, your commission may be delayed. If the delay continues after reasonable reminders, Meg may cancel the booking and assess any refund in accordance with the cancellation section above.
Estimated Timeframes
Your estimated waitlist timeframe will be discussed when a commission is offered.
The waitlist period is separate from the painting timeframe which is confirmed when the artwork is booked in.
All timeframes are estimates unless a specific date has been agreed in writing. Delays caused by late payments, missing information, delayed approvals or circumstances outside Meg's reasonable control may extend the timeframe.
Delivery and Shipping
Shipping is paid by the client and will either be quoted separately or added to the final invoice.
Deliveries require a signature. You are responsible for responding to courier notifications and accepting delivery when reasonably possible. If delivery is missed or refused after three delivery or rebooking attempts, any additional courier, return or redelivery costs may be charged to you.
For international deliveries, you are responsible for any customs duties, import taxes or other charges imposed by the destination country.
If shipping is arranged through amegstudio and the artwork is damaged or lost in transit, Meg will manage the matter with the courier and cover the reasonable cost of repair, replacement or redelivery, or provide an appropriate refund where necessary.
If you arrange your own courier, you are responsible for that courier’s handling and delivery services, except where otherwise required by law.
If your artwork arrives damaged, please contact Meg as soon as possible and provide photographs of the artwork and packaging.
Ownership and Copyright
Copyright in the original artwork, Photoshop visualisation, concepts and designs remains with Meg unless otherwise agreed in writing.
Once the artwork has been paid for in full, you own the physical original artwork.
Any prints or reproductions must be ordered through amegstudio. The artwork may not be commercially reproduced, resold as a design or substantially altered without Meg’s written permission.
Each original artwork includes a certificate of authenticity.
Portfolio and Privacy
Unless you opt out in writing, Meg may photograph and share your completed artwork on the amegstudio website, social media and marketing materials.
You may opt out at any time by emailing meg@amegstudio.com.au. If you opt out, Meg will not use identifiable images of your children or artwork in future marketing, unless otherwise agreed.
Personal information and reference photographs will only be used to create and manage your commission. Please refer to the amegstudio Privacy Policy for further information.
Circumstances Outside Meg's Control
If illness, material shortages, natural events, courier disruption or another circumstance outside Meg’s reasonable control affects your commission, Meg will notify you and provide an updated timeframe.
If Meg is unable to complete the commission, all amounts paid for the uncompleted portion will be refunded.
Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
For major failures with the service, you are entitled:

to cancel your service contract with us; and
-
to a refund for the unused portion, or to compensation for its reduced value.
You are also entitled to be compensated for any other reasonably foreseeable loss or damage.
You are also entitled to choose a refund or replacement for major failures with goods.
If a failure with the goods or service does not amount to a major failure, you are entitled to have the problem rectified in a reasonable time. If this is not done, you may be entitled to cancel the service contract and obtain a refund for the unused portion.
Acceptance
These Terms and Conditions, together with your individual quote and any agreed written changes, form the agreement between you and amegstudio.
By accepting your quote and paying the deposit, you acknowledge that you have read and agreed to these Terms and Conditions.
